Acceptance of Terms
By accessing or using the smsdora platform, website, and related services (collectively, the "Service") operated by smsdora ("smsdora," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms").
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Service.
Eligibility & Account Registration
You must be at least 16 years of age (or the applicable minimum age in your jurisdiction) to create an account and use the Service. By creating an account, you represent that the information you provide is accurate and complete.
You may register an account using an email address and password, or by authenticating through Google OAuth ("Sign in with Google"). In either case, you are responsible for the security of your account credentials. We do not store your Google password.
You are responsible for maintaining the confidentiality of your account credentials, including your password and API keys. You agree to notify us immediately of any unauthorized access to your account.
We reserve the right to suspend or terminate accounts that we reasonably believe contain inaccurate information, violate these Terms, or are used for fraudulent or abusive purposes.
Description of the Service
smsdora is a software platform that enables users to send and receive SMS messages through real Android devices connected to the platform. The Service provides:
- A web-based dashboard for managing devices, messages, campaigns, templates, and API keys
- A REST API for programmatic SMS sending and device management
- A mobile companion app for Android devices that executes SMS dispatch jobs
- Incoming SMS reception — connected devices can receive inbound messages and sync them to your inbox
- Operational logging and delivery status tracking
- Campaign and template management with Excel import support
- Outbound webhook notifications for SMS delivery events (where configured)
- Subscription billing managed through Stripe
The Service acts as operational tooling and software infrastructure. SMS messages are transmitted through users' own physical Android devices and mobile carrier networks. smsdora does not operate as a telecommunications carrier or aggregator.
Subscription & Billing
Free Trial
New accounts receive a 7-day free trial with access to 1 connected device and full platform functionality. No credit card is required to start the trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. If you do not subscribe, your account will be paused — your data is preserved and you can reactivate at any time by choosing a plan. You will not be charged automatically when the trial ends.
Paid Plans
The Service offers the following subscription plans:
- Starter — $12/month (or $115.20/year): 1 connected device, full platform access
- Team — $25/month (or $240/year): Up to 5 connected devices, campaign management
- Business — $50/month (or $480/year): Up to 10 connected devices, advanced analytics, dedicated support
All paid plans include access to the dashboard, REST API, message logs, templates, incoming SMS, and Excel import. Campaign management is available on Team and Business plans. Pricing is subject to change with reasonable notice.
Billing Intervals
Subscriptions are available on a monthly or yearly basis. Yearly plans are billed as a single annual payment and receive a 20% discountcompared to the equivalent monthly rate. The billing interval you select at checkout applies for the full duration of that subscription period.
Payment Processing
All subscription payments are processed by Stripe, our third-party payment processor. By subscribing to a paid plan, you agree to Stripe's Terms of Service. smsdora does not store your payment card details. Stripe stores and manages all card data in accordance with PCI-DSS standards.
We use Stripe webhooks to receive real-time payment and subscription events (e.g., payment succeeded, subscription renewed, subscription cancelled). These events are used to update your account access status. Webhook payloads are verified using Stripe's cryptographic signature mechanism before processing.
Billing Portal
You can manage your subscription, update your payment method, view billing history, and download invoices through the Stripe-hosted billing portal, accessible from your account settings. Upgrades, downgrades, and cancellations are processed through this portal.
Device Limits
Each plan limits the number of active devices you can connect simultaneously. If you exceed your plan's device limit, additional devices cannot be registered until you upgrade your plan or deactivate existing devices.
Payment and Renewal
Subscriptions renew automatically at the end of each billing period (monthly or yearly) unless cancelled before the renewal date. You may cancel your subscription at any time via the billing portal. Cancellation takes effect at the end of the current billing period — you retain access until then.
We do not typically provide refunds for partial billing periods, except where required by applicable law or at our sole discretion.
Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with these Terms. You must not:
- Send SMS messages that violate any applicable law, regulation, or industry standard
- Send spam, unsolicited commercial messages, or messages without proper recipient consent
- Use the Service to harass, threaten, defraud, or impersonate any person or entity
- Transmit malware, phishing links, or other harmful or deceptive content
- Attempt to bypass rate limits, device limits, or other platform restrictions
- Reverse engineer, decompile, or attempt to extract source code from the Service
- Use the Service to compete directly with smsdora or build a substantially similar product
- Interfere with or disrupt the integrity, security, or performance of the Service
- Sublicense, resell, or share access to your account or API keys with unauthorized parties
- Abuse the free trial (e.g., creating multiple accounts to repeatedly access trial features)
- Use the incoming SMS feature to intercept or monitor messages without proper authorization
We reserve the right to investigate and take appropriate action against violations, including suspension or termination of your account.
SMS Compliance Responsibilities
You are solely responsible for ensuring that all SMS messages sent through the Service comply with applicable laws and regulations, including but not limited to:
- Telephone Consumer Protection Act (TCPA) in the United States
- General Data Protection Regulation (GDPR) in the European Union
- Privacy and Electronic Communications Regulations (PECR) in the United Kingdom
- Canada's Anti-Spam Legislation (CASL)
- Any other national, regional, or local laws governing SMS communications, telemarketing, data privacy, or consumer protection in your jurisdiction
This includes obtaining proper consent from recipients before sending messages, providing opt-out mechanisms where required, and maintaining records of consent as applicable.
You are also responsible for ensuring that your use of the incoming SMS feature complies with all applicable privacy and telecommunications laws in your jurisdiction. You must not use the incoming SMS feature to intercept communications you are not authorized to receive.
smsdora provides software tools for SMS operations. We do not monitor the content or legality of individual messages sent through the platform. You bear full legal responsibility for the messages you send and receive.
User Responsibilities
As a user of the Service, you are responsible for:
- Maintaining the physical security and proper functioning of your connected Android devices
- Ensuring devices have active SIM cards, adequate battery, and a stable data connection
- Keeping the companion mobile app updated to the latest version
- Securing your account credentials, API keys, and any webhook endpoint secrets
- Monitoring your message logs, inbox, and device status through the dashboard
- Complying with your mobile carrier's terms of service and acceptable use policies
- Paying all carrier charges, data usage fees, and SMS fees associated with your connected devices
- Ensuring any webhook endpoints you configure are secured and accessible
- Keeping your billing information current in the Stripe billing portal to avoid service interruption
Third-Party Carrier, Device & Network Limitations
The Service relies on third-party infrastructure that is outside our direct control. You acknowledge and agree that:
- SMS delivery depends on mobile carrier networks, which may throttle, delay, filter, or block messages
- Device behavior, operating system restrictions, battery optimization, and Android version differences may affect SMS dispatch and reception reliability
- Firebase Cloud Messaging (FCM) is used for push notifications to connected devices and is subject to Google's terms, availability, and performance
- Stripe's availability and uptime affects billing and subscription management functionality
- Google OAuth availability affects users who authenticate via "Sign in with Google"
- Internet connectivity, network outages, and carrier policies are beyond our control
- We do not guarantee SMS delivery, delivery speed, or delivery confirmation from carriers
smsdora provides software tooling to orchestrate and track SMS dispatch. Actual message transmission is performed by your devices through their respective carrier networks.
Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide reasonable advance notice when possible)
- Unscheduled downtime caused by infrastructure issues, security incidents, or force majeure events
- Third-party service outages (hosting, FCM, Stripe, Google OAuth, etc.)
We are not liable for any damages or losses resulting from service interruptions or downtime.
Intellectual Property
The Service, including its code, design, branding, documentation, and all related intellectual property, is owned by smsdora and is protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms for the duration of your subscription or trial. This license does not grant you any rights to our trademarks, logos, or brand assets.
You retain ownership of the data you submit to the Service, including message content, recipient lists, and templates. By using the Service, you grant us a limited license to process this data solely for the purpose of providing the Service.
Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us an unrestricted, perpetual, royalty-free right to use, modify, and incorporate that feedback into the Service without any obligation or compensation to you.
Suspension & Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms, engage in prohibited activities, fail to pay subscription fees, or if we reasonably believe your use of the Service poses a risk to the platform, other users, or third parties.
You may terminate your account at any time via the billing portal or by contacting us. Upon termination:
- Your access to the dashboard and API will be revoked
- Connected devices will be deregistered from the platform
- Active subscriptions will be cancelled through Stripe at the end of the current period
- Your data will be deleted or anonymized in accordance with our Privacy Policy
- Pending messages in the queue may not be delivered
Termination does not relieve you of any obligations incurred before termination, including outstanding payment obligations.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- SMS messages will be delivered to their intended recipients
- Stripe payment processing will be available at all times
- Google OAuth authentication will be available at all times
- The Service will meet your specific requirements or expectations
- Results obtained through the Service will be accurate, reliable, or complete
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMSDORA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, INCLUDING ANY FAILURES OF THIRD-PARTY SERVICES SUCH AS STRIPE, FIREBASE, OR GOOGLE OAUTH.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the limitation or exclusion of liability for certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless smsdora and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- The content of SMS messages you send through the platform
- Your use of the incoming SMS reception feature
- Your violation of any applicable law, regulation, or third-party right
- Any claims made by recipients of messages sent or received through your account
- Any misuse of the free trial, including multiple account creation to circumvent trial limits
Governing Law
These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation where possible, and otherwise subject to binding arbitration or the jurisdiction of a competent court, as appropriate under applicable law.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and notify you through the Service or by email where appropriate.
Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you should stop using the Service and close your account.
